1. Agreement and account authority

These Terms form an agreement between you and DREAMLAB STUDIO PTY LTD (ABN 77 673 584 426), an Australian Private Company registered for GST and trading as Dreamlab Galleries. By creating an account, purchasing a subscription, accepting these Terms at checkout or using the service, you agree to these Terms and the policies linked from them.

You must be at least 18 and legally able to enter this agreement. If you use Dreamlab for a studio, company or other organisation, you confirm that you are authorised to bind it. You are responsible for accurate account details, authorised team access, account security and activity carried out through your workspace.

2. The Dreamlab service

Dreamlab provides tools for uploading, organising, processing, proofing and delivering photography and video; collecting client favourites, comments and approvals; creating album layouts; managing teams; and related creative-business workflows. Available features, limits and service stages depend on the selected plan and any add-ons shown at purchase.

Features described as beta, preview, early access or presale may change and may be unavailable at times. We will not materially reduce a paid plan during its current billing term without a reasonable substitute, credit, right to cancel or other remedy required by law.

3. Your content and permissions

You retain ownership of content you upload. You grant Dreamlab and its contracted service providers a worldwide, non-exclusive, royalty-free licence to host, copy, encode, process, display and deliver that content only as needed to operate, secure and improve the services you request.

You confirm that you have the necessary copyright, privacy, model, location and contractual rights to upload and process the content and to invite each intended viewer. You remain responsible for the legality, accuracy and final use of your content. The licence ends when content is deleted from our active systems, subject to reasonable technical retention in protected backups and legal records.

4. Clients, reviewers and shared links

You control the people invited to galleries, albums and review rooms and are responsible for choosing suitable password, expiry, download and privacy settings. Anyone with a valid unprotected link may be able to access its content. You must notify us promptly if a link or account has been exposed.

You are responsible for your relationship with your clients, including delivery promises, image licences, print or album agreements, reviewer permissions, notices and dispute resolution. Dreamlab provides the platform and is not a party to your photography or filmmaking contract.

5. AI-assisted and automated tools

Intelligent culling, editing, tagging and album-layout features produce recommendations. They do not replace professional judgment and may miss, rank or alter content unexpectedly. You must review outputs before publishing, deleting originals, ordering products or delivering work.

Dreamlab does not claim ownership of your original media because it has been processed by an automated feature. Additional terms shown for a personal editing profile or third-party processor form part of these Terms.

6. Storage, usage and fair use

Plans may include limits for annual uploads, active retained storage, culls, edits, video processing, project numbers and team seats. “Annual uploads” measures data transferred during a subscription year and is not a promise of permanent archival storage. Active storage may require additional payment or removal of content above the plan allowance.

Dreamlab is a workflow and delivery service, not the sole backup of your original files. You must maintain independent originals and exports. We may apply reasonable technical limits to protect service performance and may ask a studio with unusual or abusive usage to reduce usage, purchase capacity or move to an appropriate plan.

7. Pricing, subscriptions and tax

Prices, billing frequency, included usage and taxes are shown before purchase. Prices marked “+ GST” are exclusive of Australian GST and are intended for professional or business customers. The GST-inclusive total will be shown before payment. You authorise the payment provider to charge the amount shown at checkout.

Subscriptions renew for the stated monthly or annual term unless cancelled before renewal. We will provide notice of material price changes before they apply to a future renewal. Add-ons may have separate usage periods and may be consumed when processing begins. You are responsible for taxes not collected by us where applicable.

8. Founding 30 reservations and presale

A no-payment Founding 30 request records your interest and preferred plan; it is not a purchase, guarantee of service availability or obligation to buy. We may verify studio eligibility, remove fraudulent or duplicate requests and place requests received after capacity is reached on a waitlist.

An eligible reserved studio may choose to pay the refundable founding deposit shown at checkout, plus applicable GST. The deposit secures priority onboarding and will be credited in full against the studio’s first annual subscription invoice. You may request a full refund before the deposit is applied to that invoice. If Dreamlab cannot offer the agreed onboarding, we will refund the deposit. After it is applied to an activated subscription, the ordinary subscription cancellation and refund terms apply.

If invited, you will receive the final plan inclusions, launch timing, GST-inclusive price, payment terms and these Terms before paying the annual balance. The advertised 20% discount applies to the first paid annual term of an eligible photography plan. Unless the invitation states otherwise, renewal is at the standard price then published for that plan.

9. Cancellation, account closure and refunds

You may cancel renewal through the available account controls or by contacting support. Cancellation generally takes effect at the end of the paid billing term, and access continues until then. Deleting an application does not automatically cancel an active subscription.

Refunds and billing corrections are governed by our Cancellation & Refund Policy. Nothing in these Terms excludes, restricts or modifies rights that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees.

10. Dreamlab intellectual property

Dreamlab and its licensors retain all rights in the platform, software, interfaces, designs, documentation, brand assets and service-generated materials other than your content. We grant you a limited, non-exclusive, non-transferable right to use the service during your authorised subscription.

If you provide ideas or feedback, you allow us to use them without restriction or payment, but we will not publicly attribute confidential feedback to you without permission.

11. Acceptable use, suspension and service changes

You must follow our Acceptable Use Policy. We may restrict or suspend access where reasonably necessary to prevent harm, secure the service, address non-payment, comply with law or investigate a material breach. Where practical, we will provide notice and an opportunity to remedy the issue.

We aim to provide a reliable service, but availability may be affected by maintenance, internet conditions, third-party providers and events outside reasonable control. We may update or discontinue features, while respecting paid-term commitments and non-excludable rights.

12. Liability, consumer guarantees and governing law

To the maximum extent permitted by law, Dreamlab is not liable for indirect or consequential loss, lost profits, lost opportunities or loss arising from a failure to maintain independent originals, unauthorised shared-link access caused by your settings, or unreviewed automated outputs. Where liability may lawfully be limited, our aggregate liability relating to the service is limited to the fees you paid for the affected service in the 12 months before the event.

These limitations do not apply where prohibited by law, to fraud or wilful misconduct, or to consumer guarantees and other rights that cannot be excluded. If a non-excludable guarantee applies, available remedies are those provided by law.

These Terms are governed by the laws of Victoria, Australia. Before commencing formal proceedings, each party agrees to make a genuine attempt to resolve the dispute by written notice and good-faith discussion, except where urgent relief is required. Contact legal@dreamlabmotion.shop.
